PATRIOTIC Front (PF) Information and Publicity Committee Member Sunday Chanda has clarified that Felix Mutati, Lucky Mulusa and Nathaniel Mubukwanu are qualified to be nominated as Members of Parliament.
President Edgar Lungu on Thursday nominated some new Members of Parliament.
Among the MPs Nominated and also appointed as Ministers are, MMD president and former Lunte MP Felix Mutati who has been appointed as Finance Minister, Former Solwezi Central MP Lucky Mulusa as National Development Minister and Former Mongu Central MP Nathaniel Mubukwanu as Western Province Minister.
However, the appointments of the trio into parliament have been criticized by the MMD Nevers Mumba led faction who have demanded that President Lungu should revise the appointments because the Amended Constitution does not allow them to be nominated as they served as MPs before the last preceding general election. According to the faction’s spokesperson Reverend Reuben Sambo, the appointments of Mr. Mutati, Mr. Mulusa and Mr. Mubukwanu were illegal, null and void.
But Mr. Chanda has charged that such statements were misleading and a misinterpretation of the law.
He explained that the Constitution allowed the trio to be nominated because they did not take part in the last preceding general election. “Article 69 (3) clearly states that a person who was a candidate in the last preceding general election or a subsequent by-election, is not eligible to be nominated as a Member of Parliament. Mr. Sambo must know that the last preceding general election was on the 11th of August 2016, Sso far there has not been any subsequent by-election following upon the last general election. “The three nominated MPs were candidates in 2011 and the 2011 general election is not the last preceding general election but rather, the second last preceding general election. Therefore none of them took part in the last preceding general
election,” Mr Chanda said.
He advised Mr. Sambo to withdraw his statement and take time read the Amended Constitution to avoid issuing misleading
statements in the future.
