THERE was drama in a Lusaka Local Court when a man admitted making love with a married woman because he thought she was single and was later fined K10, 000 for adultery.
This was heard in Kanyama Local Court in a case in which John Kapasa, 28, of Chibombo sued Wellington Kapaso, 25, of Kanyama compound for adultery.
When the claim was read, wellington readily admitted making love with John’s wife.
John told senior court Magistrate Daniel Phiri sitting with Magistrates Ackim Phiri and Sarah Nyendwa at Kanyama Local Court that he was on separation with his wife for a month.
He explained that when he reconciled with her, he was surprised that she had lost interest in having sex with him and he suspected she had a boyfriend.
John said that he later put his wife’s phone on recording and that he discovered that she was always talking to Wellington telling him about terminating the pregnancy.
John further said that his wife confessed making love with Wellington and that prompted him to trace him.
In cross-examination, John said that he did not have evidence that Wellington made love with his wife.
In defence, Wellington said that it was true he made love with John’s wife but he thought she was single.
He explained that he asked John’s wife if she was married and she told him she was single and that was the reason he developed a relationship with her, adding that he made love to her only once.
Magistrate Phiri said that going by John’s wife’s confession; she committed adultery with Wellington who also readily admitted the act.
He ordered Wellington to compensate John with K10, 000 with initial payment of K1,000 followed by monthly instalments of K400.
