A 39-year-old adulterous wife has turned into a witness in a case in which her husband sued his best friend for adultery.
Yandika Mvula testified that she was in the habit of making love with Panganani Tembo in lodges whenever her husband, Wallace Soko went on out of town work trips.
This is a matter in which Soko, 37, sued Tembo for adultery.
The matter was being heard at Matero Local Court by Senior Court Magistrate Lewis Mumba sitting with Magistrate Pauline Newa.
Soko told the court that Tembo made love to his wife, Mvula the whole night before he caught the two in the act around 04:00 am on February 3, 2016.
He explained that Tembo knew that Mvula was his wife because on three occasions he visited his home and even had a meal of nshima.
Soko said although he had heard rumours from his friends that Tembo was his wife’s boyfriend, he did nothing because he had no proof.
Soko said that he married Mvula and paid dowry and that he was therefore demanding to be compensated.
Mvula testified that she had a habit of making love with Tembo in lodges whenever Soko went for work trips outside town.
She testified that on the night she was caught with Tembo he made love to her on a chair.
In defence, Tembo said he was not aware that Mvula was married as she used to frequent bars.
He explained that Mvula spent a night with him but he did not make love to her because she was not his class.
When delivering judgment, Magistrate Mumba ordered Tembo to compensate Soko K15, 000 with initial payment of K1000 followed by monthly instalments of K500 and advised the couple to go for counselling.
