Ex-minister sues over property

FORMER Finance Minister Situmbeko Musokotwane has petition the Lusaka High Court to order that he is the rightful owner of stand number 33865 which he wants converted to his name.

This is according to a statement of claim filed at the Lusaka High Court by  Dr Musokotwane as first plaintiff and Mate Musokotwane as second plaintiff.

This is a matter in which Dr Musokotwane has sued the seller of the property Henry Fanuel Mitti.

Dr Musokotwane  has argued that he signed a Contract of Sale with Mr  Mitti for the property in Lusaka in the amount of K540,000 which  he had completed payment for its purchase. He explained that he paid a deposit fee of K300,000 over the property  in question on condition that the balance be liquidated  in a monthly installments to the defendant.

“The Plaintiffs paid the balance of K240,000 in monthly installments as agreed and the defendant instructed the plaintiff to withhold the sum of K54,000 for property Transfer Tax to Zambia Revenue Authority.

Dr Musokotwane is therefore requesting for an order to execute the assignment of stand number no. 37865 in his favour, as well as damages to be assessed for the delays in the completing the transaction, cost and further relief as deemed by the court.
