CONSTITUTIONAL COURT UNDERWAY- SPEAKER

SPEAKER of the National Assembly Patrick Matibini says he has been in contact with the Head of the Executive over the establishment of the Constitutional Court as provided for in the new Constitution.

Dr Matibini said measures were currently being put in place for the establishment of the constitutional court.

The Speaker was responding to UPND Monze Central members of Parliament Jack Mwiimbu’s point of order who questioned the delay in the establishment of the Constitutional Court.

Mr Mwiimbu warned that the nation would face a constitutional crisis if the court was not established immediately.

“Mr Speaker, I rise on a very serious constitutional point of order. I am aware that in the new constitution article 101 provides for the establishment of a constitutional court but is the Vice President Inonge Wina in order not to inform the House on the progress made on the establishment of the Constitutional Court?”

He demanded that the Speaker makes a ruling on the matter. But in his response, Dr Matibini said he had been in contact with the Head of the Executive and assured Mr Mwiimbu and the entire House that measures were being put in place for the establishment of the Constitutional Court.

Meanwhile UPND members of Parliament yesterday walked out of Parliament in protest after the Speaker ordered Sinda MP Levy Ngoma to leave the House for the rest of the day.

Dr Matibini ordered Mr Ngoma to leave the House for emotionally passing a running comment when Home Affairs Minister Davis Mwila was responding to his question on the alleged selective application of the Public Order Act.

Mr Ngoma had asked Mr Mwila in a follow up question to his earlier statement to explain why he had a tendency of referring to PF members as “suspected” even when there was tangible evidence.

But when Mr Mwila was in the process of answering the question, Mr Ngoma was heard shouting on top his voice with emotions “You are lying!” while pointing at Mr Mwila. Dr Matibini’s decision incensed UPND  MPswho immediately walked out of the House led by Choma member of Parliament Cornelius Mweetwa around 15:40 hours.

Other who walked out included MMD’s Kasempa MP Kabinga Pande, PF Chongwe MP Sylvia Masebo and MMD Ikelenge Elijah Muchima.

After walking out the House, the MPs were spotted having an emergence meeting at the foyer.

Meanwhile, MMD Kasengwa Member of Parliament Victoria Kalima was seen celebrating together PF members over the decision by Dr Matibini to chase out Mr Ngoma.
