Prison escapee sent back to jail

A MAN who escaped from Mwembeshi Open Prison has been jailed for 12 months imprisonment with hard labour.

Sylvester Banda, 26, of house no. 57/28 Mtendere East, was sent to jail by Lusaka Magistrate Alice Walusiku after he was found guilty as charged.

Sentencing him, Ms Walusiku said it was not in dispute that Banda escaped from lawful custody as a remandee and for that reason she would fail in her duty not to send him back to prison.

In mitigation Banda pleaded with the court to exercise maximum lenience on him as he did not know what he was doing, claiming he was a bread winner and once sent to jail his family would die of hunger. The court heard that on June 1 last year Banda escaped from Mwembeshi Open Prison where he was serving an 18 months jail sentence for breaking into a building and committing a felony.

He escaped around 14 hours when he was in a company of other prisoners who were working within the prison camp.

A few months later Banda was arrested and remanded at Lusaka Central Prison facing another charge of criminal trespass.
