Small scale farmers sue ZNFU

 

Farmers in Lufwanyama district of the Copperbelt Province have sued the Zambia National Farmers Union (ZNFU) for breach of contract.

The ZNFU has been sued by Lufwanyama farmers for allegedly failing to supply  the farm inputs as agreed in the contract hence causing them to fail to prepare and plant their crops for 2014/2015 farming season in their respective five hectares of land.

Moses Musonda and 10 others, as plaintiffs in the matter, have filed their petition in the Kitwe High court.

The plaintiffs stated that they were small scale farmers while the defendant was an organization established by large scale farmers to promote the interests of all members in the country.

The small scale farmers have stated  that on August 20 2014, they entered into an agreement with ZNFU in which the union was to supply  farming inputs such as fertilizer, maize, soya bean seeds  and weed killer.

The  agreement was made in consideration that the plaintiffs pay  the defendants K84,710,  clear  land in extent of 55 hectares and  meet  labour costs,  while the defendants were to supply  farming inputs within seven days of the date of the said agreement.

The plaintiffs further contended that the   contract entered into, also included a crop insurance policy which was taken out in favour of the plaintiffs with a reputable insurance company to cover the farmers crops for the 2014/2015 farming season.

The defendants failure or negligence to supply   the farming inputs as agreed have caused  the plaintiffs to fail to prepare and plant their crops for 2014/2015 farming season in their respective five hectares of land.

“The failure by ZNFU who are the defendants in this case has caused us to fail to prepare and plant our crops for 2014/2015 farming season in our respective five hectares of land. As a result, we have suffered loss and damages,” they said.

The plaintiffs are claiming loss of the expected crop yield for the 2014/2015 farming season in respect of the five hectares of land each.

The plaintiffs are also claiming damages for breach of contract, mental torture, anguish K238, 430, money paid to the defendant
