A MAN sent people into laughter in a Local Court in Lusaka when he said that he was free to make love to his wife any time he felt so.

Moses Yumbe, 33, of old Kanyama compound said although his wife told him that people made love only at night, he was free to make love to her any time because she was his wife.

He was testifying in a case in which his wife, Rebecca Banda, 28, sued him for reconciliation.

The two got married in 2004 and have four children. Dowry was paid.

Banda told Senior Court Magistrate Sarah Nyendwa sitting with Magistrates Ackim Phiri and Daniel Phiri at Kanyama Local Court that she only stayed well  in her marriage when she had two children because after that Yumbe started telling her that she was not his choice.

She explained that Yumbe tortured her for one year after he impregnated a Congolese woman and that he hated her for telling him that he was a womanizer.

Banda said that in 2007 Yumbe gave her K10 for home use and life became tough for her.

She further stated that in 2013 a  a young man came to their home and told her to tell Yumbe to stop flirting with his wife.

“In 2014 Yumbe could not leave money for food but was coming with bottles of Mosi lager beer at midnight.

When he started leaving money for food he increased it to K20 from K10,

“Since August 2015 he doesn’t make love to me; we sleep like sister and brother. He even boasts that he can do anything with his manhood,” said Banda.

Banda said that she came to court because Yumbe denies her sex and feared this could force her into finding a boyfriend and land herself in more problems.

In defence, Yumbe said that Banda was his wife and he could make love to her any time he felt like although she told him that people do it at night.

Asked by Banda why he came home at midnight, Yumbe replied that it was his house and he could come home even at 03.00 hours.

In submission, Banda said that she wanted Yumbe to tell her the truth if he loved her or not. Yumbe said that he loved Banda and that it was for better and for worse.

Magistrate Nyendwa told Yumbe that it was wrong for himto tell Banda that she was not his choice.

She said that Banda was young to be denied sex and that in the event she was found with another man Yumbe will rush to court to sue for adultery. She reconciled the couple.
