‘I did not father our first child’


A remark by a  Lusaka man that he  was not the father of  their first daughter has put his marriage on the rocks.

Paxina Ng’andu told Senior Court Magistrate Sarah Nyendwa sitting with Magistrates Daniel Phiri and Ackim Phiri at Kanyama Local Court that all was well until her husband Lazarus Phiri told her that he was not the father of their first daughter.

This is in a case in which Ng’andu,32, took her husband to court for reconciliation.

But Phiri, 39, told the court in Lusaka that  apart from that, his wife tells him that she is tired whenever he wants to make love to her.

The two got married in 2004 and have three children. Dowry was paid.

Ng’andu said that on June 19, Phiri packed his belongings and went to stay with his sister and subsequently found a house of his own where he currently stays alone.

It was at this point that she decided to seek help from the court because the church has failed to resolve their matters.

In defence, Phiri said that Ng’andu always complains to him that she is tired whenever he wanted to make love to her.

He explained that Ng’andu does not respect  him and she insults him in public.

Phiri further stated that Ng’andu was mistreating his niece because she would wake her up at 04.00 hours to draw water.

“I don’t have peace so when I knock off I spend some time at the road to pass time so that I just go straight to bed when I go home,” he said

Asked by the court why he is refusing to be the father of the first child, Phiri said that he refused responsibility because of the difference in months he stayed with Ng’andu.

In submission,Ng’andu said that she wanted to reconcile with Phiri.

Phiri said that he was ready to reconcile with Ng’andu but she should be giving him respect and that she should go to marriage counsellors for help.

Passing judgment, Magistrate Nyendwa said that Ng’andu was wrong to deny Phiri sex by claiming she was tired.

She said that Ng’andu is a foolish woman who was toying with marriage.

She told Phiri also to go for DNA test for his first born child because he was giving her a spirit of rejection.

She reconciled the couple and told Ng’andu to start making love with Phiri, adding that if Ng’andu does not change he should sue for divorce.
