Lawyer sues client over K300, 000 legal fees

A LUSAKA-based lawyer has sued Skyline Quarry Limited for failing to pay him over K300, 000 legal fees for services he rendered in a matter in which it was dragged to court by Vikram Investments Limited.

Mr Siakamwi Chikuba managing partner of BCM Legal Practitioners has dragged Skyline Quarry Limited to court for allegedly neglecting to pay the legal fees incurred. Mr Chikuba of number 12 Central Street Chudleigh in Lusaka said his law firm and Skyline Quarry entered into an agreement and the defendant agreed to pay the money from the work he did in the matter.

In an affidavit in support of summons filed in the Lusaka High Court recently, Mr Chikuba asked the court to pass judgment against his client because Skyline acknowledged the bill and agreed to pay. “An agreement was entered on the 14th of May, 2015 wherein the defendant agreed to pay and acknowledged the debt in the sum K308, 000 arising out of the work done in the matter in which the defendant was sued.

“The defendant has todate failed or neglected to repay the legal fees.  I crave the indulgence of this honourable court in ordering that judgment in admission be entered against the defendant for the admitted sum,” Mr Chikuba said.

He said by virtue of a retainer agreement on November 13, 2014, his law firm would further add that it had been representing Skyline Quarry and that the defendant was at all material times happy with the services rendered.

“The plaintiff will aver that on the 18th of February 2015, it rendered a bill and or fee note, detailing all the work done in the sum of K308, 000.00 and that the same was acknowledged and or received by the defendant’s agent on the 24th of February 2015,” he said.
