M’membe contempt case on today

The case in which former president Rupiah Banda has asked his lawyers to undertake a private prosecution of  Post Newspaper editor Fred M’membe comes up today.

This is the matter in which the Director of Public Prosecutions (DPP) Mutembo Nchito has decided to take over the case to prosecute the case.

However president Banda feels that Mr Nchito cannot prosecute his business partner and friend.

In another case, where president Banda has rejected being prosecuted by Mr Nchito, the matter has been referred to the High Court to determine constitutional issues.

This is a straight forward case. Nchito shouldn’t be on this case on moral and ethical grounds.
