LAZ asked to appeal its case

Senior lawyers are astounded that the Kitwe high court dismissed the Law Association of Zambia application challenging the appointment of acting chief justice Lombe Chibesakunda by President Michael Sata on a technicality.

They said LAZ was a professional body and had consulted widely before instituting court proceedings on the matter and that the reasons and process were valid.

They have now called on the Law Association of Zambia (LAZ) to appeal against the dismissal of its case by the Kitwe High Court.

They said it was in the interest of the nation that the legal body appealed the matter.The lawyers said the decision by LAZ to challenge justice Chibesakunda’s appointment was arrived at during an extra ordinary meeting that was convened at Mulungushi International Conference Centre where all lawyers agreed that the matter should be contested in court. They said LAZ should appeal the matter because it had prayed that Justice Chibesakunda should vacate office as she did not qualify to hold the office of substantive chief justice having attained the age of 65 years.The lawyers said judicial review was not the only way the association could challenge the appointment as suggested.
