The chief justice saga will go down in Zambian judicial history as the scandal of the year, Brigadier General Godfrey Miyanda has charged.
And the Judicial Complaints Authority has responded to the letter of complaint by the Zambia Direct Democracy Movement (ZDDM) president Edwin Sakala and his deputy Charles Kafumbo against Acting Chief Justice Lombe Chibesakunda’s presiding over the appeal in a case involving Dora Siliya and two others.
Judicial Complaints Authority secretary Dr Winnie Sithole Mwenda said the authority acknowledged the receipt of the complaint letter against Justice Chibesakunda and that the complaint shall be laid before the authority for consideration in accordance with the provisions of section 26 (2) of the judicial (code of conduct) Act No 13 of 1999 as amended by Act No13 of 2006.
In a statement released yesterday, Big Gen Miyanda questioned asked Zambians to examine whether acting Chief Justice Lombe Chibesakunda, who has been at the helm of the Judiciary at the will of President Sata and his Justice Minister Wynter Kabimba, was an accomplice in her continued illegal stay in office.
The opposition Heritage Party premier pointed to events preceding the barring of Dora SILIYA, Maxwell Mwale, and Hastings Sililo from contesting the polls as ‘the smoking gun’ that should make Zambians question the conduct of named court officers, and ruling PF leaders.
“Events immediately preceding the postponement of nominations for the three constituencies involving Honourable Mwale, Siliya and Sililo point to questionable conduct by the Minister of Justice Wynter Kabimba, which require a truthful answer or answers by the minister. Barely hours after he threatened to “engage the court” the Judiciary public relations officer made that infamous statement that has been disowned by the Attorney General. This was immediately followed by the Acting Registrar’s statement, also disowned. As indicated in a previous statement, Kabimba should be cross-examined on oath to establish what process he initiated and whom he had audience with at the “court”. And what about the Solicitor General’s opinion rendered to the PF Secretary General? Unless and until he does so, speculations will continue that it was the Acting Chief Justice he consulted,” Brig Gen Miyanda said.
He has further called on Zambians to put an end to the questions around the Judiciary by demanding that Justice Chibesakunda relinquishes her position.
