Impeachment motion ready

Opposition members of Parliament have prepared a list of constitutional transgressions they plan to lodge in their impeachment motion against President Michael Sata.

Among the priority issues is the appointment of the Chief Justice.

They are also planning to table a demand for a health board.

They are charging that Acting Chief Justice Lombe Chibesakunda who did not qualify for the acting position as well as for the substantive position on account of age and her retirement status, but  was nominated by the President in contravention of the constitution.

“She is serving illegally because no judge can  serve above the position on which they retire and yet the President has decided to let her serve in that position indefinitely, thereby blocking vital judicial reforms.” They said.

They are concerned that judicial manipulation would continue to constitute a real threat to Zambia’s democratic dispensation which is dependent on impartial arbitration by the judiciary.

The MPs have noted that the manipulation of the judiciary extended to many critical areas of governance including criminal prosecution, Financial and banking services, capital projects and general operations of Government.

“Without a strong and decisive judiciary this country will continue to degenerate because those running institutions of critical importance lack credibility and professional standing, that is why this motion of impeachment will be tabled.

Solwezi Central Constituency MP Lucky Mulusa yesterday issued a press statement warning that if the Patriotic Front (PF) introduced a motion to remove immunity from former President Rupiah Banda the opposition would also simultaneously lodge an impeachment motion accompanied by a request for a medical board for the President.

There was need, he said, for more constructive dialogue to advance the developmental cause of the nation than continued polemics that would drive the country into gridlock and inertia.

    If a breach has been committed, let us go ahead and impeach instead of making it conditional on RB’s immunity
